TERMS OF SERVICE (TOS)

ARTICLE 1 - DEFINITIONS

• Platform: The GOTCHAAAA progressive web application and all its services.
• User: Any natural or legal person registered on the Platform.
• Provider/Candidate: Adult natural person User offering professional services through the Platform.
• Company: Legal entity or natural person User posting missions (commercial companies or associations/festivals).
• Mission: One-time service engagement posted by a Company.
• Service Contract: Contract generated by the Platform between a Provider and a Company.
• Commission: GOTCHAAAA remuneration corresponding to 12.5% of the pre-tax amount of each paid mission.

ARTICLE 2 - PURPOSE AND SCOPE

2.1 Purpose

GOTCHAAAA operates a digital connection platform between:

• Service Providers offering their skills for one-time missions
• Companies with temporary staffing needs

2.2 Covered Sectors

The Platform primarily covers the following sectors: events, catering/hospitality, security, logistics, reception, and other temporary service trades.

2.3 Geographic Area

The Platform operates exclusively in metropolitan France.

2.4 GOTCHAAAA's Role

GOTCHAAAA acts as a technical intermediary and is in no way:

• The employer of Providers
• The principal of missions
• A party to contracts concluded between Users

ARTICLE 3 - ACCESS AND REGISTRATION CONDITIONS

3.1 Legal Capacity

• Providers must be adults (minimum 18 years old)
• Company representatives must have the authority to commit their organization

3.2 Provider Registration

3.2.1 Registration Process

23-step process including:

• Personal information (email, date of birth)
• Professional situation and skills
• Professional documents for freelancers (SIRET, professional liability insurance, IBAN)
• Intervention area and radius
• Required consents

3.2.2 Accepted Provider Types

• Freelancers (self-employed, micro-entrepreneurs, etc.): can apply for all missions
• Non-freelancers: volunteer missions only

3.2.3 Account Validation

• Immediate activation after completion
• "Verified" badge available after manual document verification and 3 successful missions with rating ≥4/5

3.3 Company Registration

3.3.1 Process

6-step process including:

• Organization type (commercial company or association/festival)
• SIRET number validated via INSEE API
• Stripe payment setup (commercial companies only)

3.3.2 Restrictions

• Associations/festivals: volunteer missions only
• Commercial companies: paid and volunteer missions

3.4 Common Obligations

• Provide accurate, complete, and up-to-date information
• Maintain the confidentiality of credentials
• Immediately inform GOTCHAAAA in case of loss or theft of credentials

ARTICLE 4 - PLATFORM OPERATION

4.1 Mission Creation

Companies post missions specifying:

• Date, times, and location
• Required skill
• Specific conditions
• Compensation (paid missions) or benefits (volunteer missions)

4.2 Matching and Notifications

The Platform automatically identifies matching Providers based on:

• Matching skills
• Geographic area
• Availability
• Eligibility

4.3 Application

Providers apply by:

• Confirming availability and equipment
• Proposing a rate (paid missions)
• Validating the summary

4.4 Selection

The Company:

• Reviews applications
• Can accept multiple candidates
• The first candidate to confirm gets the mission

4.5 Contract

• Automatic generation of a Service Contract
• Secure electronic signature via OTP
• Archiving for 10 years

ARTICLE 5 - CONTRACT SYSTEM

5.1 Nature of the Contract

Service Contract concluded directly between the Provider and the Company.

5.2 Electronic Signature

5.2.1 Process:

• Company signature → Email OTP → Bank pre-authorization
• Provider signature (limited time) → Email OTP → Escrow capture

5.2.2 Security:

• Hashed OTP (bcrypt), 5-minute expiration, 5 max attempts
• IP recording, user agent, timestamp

5.3 Legal Effects

The Contract binds exclusively the signatory parties. GOTCHAAAA is not a party to the Contract.

ARTICLE 6 - USER OBLIGATIONS

6.1 Provider Obligations

• Hold the declared skills and qualifications
• Respect contractual commitments (attendance, schedules)
• Have the required insurance (professional liability for freelancers)
• Follow safety instructions
• Not disclose confidential information

6.2 Company Obligations

• Provide a safe and compliant work environment
• Respect French labor law
• Pay services according to the Contract
• Evaluate Providers objectively and without discrimination

6.3 Common Prohibitions

• Bypass the Platform's payment system
• Share direct contact details before Contract signature
• Post illegal, discriminatory, or misleading content
• Use the Platform for fraudulent purposes

ARTICLE 7 - RATING SYSTEM

7.1 Bidirectional Rating

Rating after each mission:

• 4 criteria rated on 5 stars each
• Optional comment (300 characters max)

7.2 Criteria:

• Punctuality
• Brief understanding
• Skill application
• Communication

7.3 Calculation:

Average of the 4 criteria

7.4 Display:

Public ratings, history of the last 3 reviews

ARTICLE 8 - CANCELLATION POLICY AND SANCTIONS

8.1 Cancellation by Provider

8.1.1 Conditions:

• Possible at any time before mission start
• Progressive sanctions if < 48h before mission

8.1.2 Progressive Sanctions:

• 1st cancellation: Warning
• 2nd cancellation: Enhanced warning
• 3rd cancellation: 7-day suspension (invisibility)
• 4th+ cancellation: 30-day suspension
• Reset after successful mission

8.2 Cancellation by Company

8.2.1 Before complete signature:

• ≥ 48h: free cancellation
• < 48h AND provider signed: prohibited

8.2.2 After complete signature:

• Provider compensation at 100%
• Payment captured and transferred in full

8.3 Automatic Replacement

• Mission automatically relisted
• Up to 5 suggested candidates

ARTICLE 9 - PERSONAL DATA

9.1 Data Controller

GOTCHAAAA is responsible for processing data collected via the Platform.

9.2 Data Collected

9.2.1 Providers:

Identification, professional, documents, geolocation, activity

9.2.2 Companies:

Identification, financial, activity

9.2.3 Contracts and payments

9.3 Purposes

• Execution of the connection contract
• Legitimate interest (service improvement, fraud prevention)
• Legal obligations
• Consent (notifications, geolocation)

9.4 Retention Periods

• User account: until deletion
• Contracts and payments: 10 years
• Connection logs: 1 year
• Geolocation: session duration

9.5 Individual Rights

In accordance with GDPR, you have the rights of access, rectification, erasure, restriction, portability, and objection.

• Supabase (EU hosting)
• Stripe (payments EU/United States)
• Mapbox (mapping United States)
• API INSEE and data.gouv.fr

ARTICLE 10 - INTELLECTUAL PROPERTY

10.1 GOTCHAAAA Rights

The Platform, its source code, design, algorithms, contract templates, trademark, and logo are the exclusive property of GOTCHAAAA.

10.2 License of Use

GOTCHAAAA grants Users a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform.

10.3 User Content

Users retain their rights to their content but grant GOTCHAAAA a worldwide license to use them in the context of the services.

ARTICLE 11 - LIABILITY AND WARRANTIES

11.1 GOTCHAAAA's Role

GOTCHAAAA is a technical intermediary providing connection, contract management, and payment security tools.

11.2 Limitation of Liability

GOTCHAAAA cannot be held liable for:

• Damages occurring during mission execution
• Non-performance or poor performance of services
• Direct disputes between Users
• Temporary technical unavailability

11.3 Best Efforts Obligation

GOTCHAAAA implements reasonable means to ensure the continuity and security of the Platform, but does not guarantee the absence of interruptions or errors.

11.4 Force Majeure

GOTCHAAAA incurs no liability in case of force majeure as defined by French case law.

ARTICLE 12 - MODIFICATIONS

12.1 TOS Modification

GOTCHAAAA reserves the right to modify these TOS at any time.

Users will be notified by email or notification in the Platform 30 days before entry into force.

Continued use of the Platform constitutes acceptance of the new TOS.

12.2 Service Modification

GOTCHAAAA may modify, suspend, or discontinue all or part of the services, subject to prior notice to Users.

ARTICLE 13 - DISPUTE RESOLUTION

13.1 Mediation

In case of dispute, the parties undertake to seek an amicable solution before any legal action.

13.2 Competent Jurisdiction

In the absence of an amicable agreement, the competent courts will be those of the location of GOTCHAAAA's headquarters, unless otherwise required by mandatory law.

ARTICLE 14 - MISCELLANEOUS

14.1 Partial Nullity

If any provision of the TOS is declared null or unenforceable, the other provisions remain in force.

14.2 Non-Waiver

GOTCHAAAA's failure to enforce any provision of the TOS does not constitute a waiver of the right to enforce it later.

14.3 Language

The TOS are written in French. In case of contradiction with a translated version, the French version prevails.

14.4 Applicable Law

These TOS are governed by French law.
